Encroachment of common area

Dear Sirs,

I'm staying in an apartment with over 100+ flats in South Bangalore and we have a registered Association managing it. One of the resident has extended his balcony into the common shaft area beam (by around 30sqft) claiming that it is not disturbing any resident. Even after a notice was served by the Association to stop the work, he completed the work without heeding to the notice. Bylaws of the association clearly states that no construction should be done in the common areas and the beams are part of the common area. Now, the resident is not ready to break the extension and restore the original structure. The flat owner staying above this flat has given a complaint that this is causing inconvenience to him. But the person who did the encroachment is threatening the association pointing out few deviations done by the builder before handing over to the association. Looking at the helplessness of the association, few other residents are also threatening to encroach some of the common areas convenient to them. How to address it?? Kindly advise

Murali ji in order to resolve the issue u need to make complaint to registrar of your area regarding encroachment on common area.
