I am in a joint property along with my sister and my father in Navi Mumbai (CIDCO). We each have 33% of the property. After my father passing away my mother got 16.7% share and the rest 16.7% share was given to my sister. My sister now has 50% share. My mother wants to give away the 16.7% share to me via Gift Deed (blood relation) to make my share 50%. The question for forum members
1. Since its an inherited property from my father does my mother have to obtain an NOC (No objection Certificate) from my sister for Registering the gift deed with the sub registrar?
2. I also have a brother and since he has not contributed to the property would there be a necessity to obtain an NOC from him for Registering the gift deed with the sub registrar?
The problem arises because it was inherited by my mother through a will from my father
