How to get divorse authomatically

Dear Experts,

How can a girl get divorse automatically . If she doesnt file divorse and also doesn't makes any contact with her husband /inlaws.

Also please advise what is ex-party divorse

Ex-party divorce when one spose filed divorce, if other spouse did not turn to court proceedings, then the divorce decree is ordered in favour of the pettitioner who filed it.

There is nothing called automatic divorce, one need to get it through court, else marriage is assumed to be live.

I got married in Nov 2011 and till date i have stayed only for 4 months at my inlaws because of my husband & in laws harassment and with recent incidence , i m staying at my parents house since nov'12 . 

Kindly advise if we should give information to police / women cell then i am staying at my parents house

The following are the grounds for divorce in India on which a petition can be filed only by the wife.

  • If the husband has indulged in rape, bestiality and sodomy.
  • If the marriage is solemnized before the Hindu Marriage Act and the husband has again married another woman in spite of the first wife being alive, the first wife can seek for a divorce.
  • A girl is entitled to file for a divorce if she was married before the age of fifteen and renounces the marriage before she attains eighteen years of age.
  • If there is no co-habitation for one year and the husband neglects the judgment of maintenance awarded to the wife by the court, the wife can contest for a divorce

Authomatically the way you spell it, there are few ways to get divorce.


1.  You file for divorce, ensure that husband or in-laws wont enter court premises for a period of six months to one year.  Insist for passing ex-parte orders and you will get divorce.  Add up a further 2 months and make sure husband and inlaws wont enter court until you get divorce decree.


2.  Make husband apply for divorce, never show up in court and follow the same procedure, judge will eventually pass exparte orders.

If nothing seems to left out for redeeming the marriage, please part ways amicably through mutual consent divorce

There is no automatic ways to get divorce....In your case you may file a divorce based on CRUELTY....A divorce by mutual consent is always a suggestable way to obtain a divorce.
