Interesting Case - Salary Settlement

Dear Sirs,

I have joined in a private MNC 2years ago.

In the appointment letter there is clause saying that "You are bound to work for about 3 years" but I did not sign any separate bond for that. Controductarly there is an another clause in the same appointment letter saying that "Either party can terminate the job by giving one month notice period"

Now I have given one month notice period and resigned my job. But my employer have deducted my one month basic salary(50K) claiming that I have breached the contract.

I think the contract itself is wrong.

Can I file a civil case? Then how long it will take to get my money?

Thanks

VIjay

you are liable to pay the amount, the contract permit you to leave employment after one year and also imposed a condition in case, you leave the job within stipulated period, you are liable to pay the amuont. both conditions are independent and can be enforced under the law but for getting enforced this condition, the employer has to file civil suit.
