Interesting Case - Salary Settlement

Dear Sirs,

I have joined in a private MNC 2years ago.

In the appointment letter there is clause saying that "You are bound to work for about 3 years" but I did not sign any separate bond for that. Controductarly there is an another clause in the same appointment letter saying that "Either party can terminate the job by giving one month notice period"

Now I have given one month notice period and resigned my job. But my employer have deducted my one month basic salary(50K) claiming that I have breached the contract.

I think the contract itself is wrong.

Can I file a civil case? Then how long it will take to get my money?

Dear Sir,

Such clauses have no meaning, you can file a claim for recovery of the amount deducted alongwith  interest and  damages against the employer. You can go through a landmark judgement on the issue-Brajo Nath Ganguly Vs Central Inland Waterways Authority, 1986 by Supreme Court of India.
