Ipc 326

Hi Sir,

One  neighbor  attacked  on my brother, he was injured and his hand
bone was broke, he and my father   went and logged complaint in police
station, they have registered FIR and asked  for go to treatment and
we went and joined  government hospital. MLC report came state that
injure happened by hiting some one  with blended weapon, after that
Police filed  charge sheet with IPC 326 section, we had  only  one eye
witness of my father, he told very good under investigation of
mejistrate, we don't have any independent witness, all witnesses
investigation is completed including doctor, police and punching
witnesses, everyone told our favour, today  munisf close the case with
neighbor favor.

 what could be the reason? and how apply to next level court? will we
get any justice in next level court? Please advice the same.

Hi Sir,

Thank you for the quick trun-around,  Is that father eye witness is accepetable in IPC 326 section? if yes, we have strong medical evidence, one eye witness of the father, two punching witness, doctor and police, all our favour.  We will appeal the decision to section court.

What is the time period to appeal the decision to next level court? how to appeal the decision.

go for appeal in the district sessions court. take your advocate in confidence and file the appeal within time

you have to appeal within 30 days. also ascertain from your advocate for it.

Hi Experts,

 

We have appealed the case in  sessions court, we have won the case.

 

Judge have punished with either 3000 rupees fine or mprisonment for 3 months and they have paid fine and  came out.
