Irretrievable breakdown of marriage

Today i have checked from one officer of Rajya Sabha and it was informed that IRBM has not been approved so far .

The draft he informed provided for equal share in residentail property of husband for wife and chilldren if wife files petition for this under section 13c which is yet to be passed.

 

Query is that this right of property will b available under new section 13c only and not in other conditions already available for divorce like cruelty ,desertion etc.

Can anyone through some light on this.

One more query if divorce case is already pending by husband against wife on d ground of cruelty and desertion ,in that case will it b open to wife to file case under IRBM or that case will b converted into IRBM automatically after 3 years.

Bill is in the air, not culminated into Act.

Wife has no rights in the property of the husband under the prevailing laws.  One need to wait till IRBM is approved by the parliament.

Yes, many bills are burried there n then & many are changed while they get final look.
