Legality of transfer of flats by developers, on the basis of mou with land owners

One of the developers from Nashik, has constructed three floor building , on the basis of  unregistered MOU signed with the land owners. Development agreement is not made. Now, the developer wants to execute registered Deed of declaration of the property, adding land owners also, as executing party. Is this declaration deed valid in the eyes of Law ?

After declaration deed, the developer wants to execute deed of Apartment.

Pl. throw light on the legality. Whether the land owners will get legal title of the constructed share of property?

An agreement can be either oral or in writing or an oral understanding can later be reduced and registered as per law.  Only local advocates can study and provide you with a suitable draft to safeguard your interests.
