My father owned 3 apartments which hav been registered under the Apartments Act . By will he transferred 1 flat in his sons name , and other two flats were given to his two daughters as streedhan with his wife having life interest in both . Now after his death changes have been made in the corporation tax receipt by deleting his name and inserting the name of his wife and daughters in the two flats .
But now the office bearers of the Apartments are not admitting the daughters as members , saying that the flat belongs to the mother , inspite of the will . Payment of monthly charges is made by daughters but the receipts are issued in the name of their brother . Also the mothers requests and complaints are ignored . Repairs to common area like drainage leak affecting the ground floor daughters flat is not done by the association and the daughets have to pay for it .
What are the reliefs and remedies under the Apartments Act against the Office bearers ? Which cout has jurisdiction .? How should changes be made to the owners name in Deed of Aparments when property is inherited .?
