Mense profits are awarded after issue of preliminary decree and most often after inquiry under O20R12. When cases take years before final decree, the amount can add up and what the consequences if the person who need to pay does not have the money?
Is there any way to pray the court to deposit some portion of the mense profit during the pending of the suit? Is so under what section of CPC.
Very likley the judgment-debtor will appeal. Is it possible to stop the appeal subject to deposit of Mense profit?
