Biswajit (In-Charge)     27 April 2012

My brother claiming my land

I am a married man with wife, son and daughter-in-law. I purchased the land in my own name in the year 1978. I gave  my brother and widow sister a shelter in my land for the sake of my mother. Can my brother and widow sister, nice who are staying on my premisis for more than 25 years can claim for right on my land?  My mother is also supporting them.

Please suggest what to do.

Dear Biswajit,

As you have purchased the land,it is your self acquired property and nobody has a right over the title or share in the property.

From what source have you purchased the land?Who is paying the requisite taxes all these years? On whose name is the water and power connection?

If it is your self acquired property, can claim a right over it.

Dear Friend,

You remain the owner of your property. But you must initiate the eviction proceedings against them. After 30 years on the property they can claim adverse possession. Therefore, do not take it on a lighter note.
