need advice ........

i m now in big problame please help me out as possible .......

i got divorce in 15 november  2010 and did secound court marriage in december 2010 .my first divorce is mutual divorce then i did second marriage (befor 90 days witout wait ) but main problem is that my second husband suddenly change his nature and evry thing always tocher me and use very bed language on phone i m still at my perents home .i didnt  stay with my second husband and losts of another problame with my second husband so can i got divorce on those base with my second husband that i didnt wait 90days when i got fist mutual divorce i did second marriage ,so on this way i can able to prove my second marriage is eligal ? i want divorce from my second husband so its possible on this base ...?

Define what problem between you and your husband?Why your husband using bad language ?

Before taking second divorce tell the reason why he was behaving like that.

i have filed for divorce in mumbai court ,mine was an abusive mentally disturbed marriage from last ten years ,i have two children ,i was living in coimbature after marriage and my marriage also happenend in coimbature .

i have filed for divorce,and custoday of children on feb4 in the mumbai court.

3 hearing have happened in mumbai family court.

suddenly i get custody of children papers that my husband had filed in coimbature ,which hearing is on april 24.

i am so confused that how can two courts have the same hearing,why is that i have to have a lawyer appointed in coimbature when i have one in mumbai ,do i have to get one...please let me know why is this procudure so difficult very confused pls help

You need to go to coimbtore and also at SC at delhi at least once to solve this issue.

Tell there that you need 1. ample time to respond 2. Case going on in Mumbai also, 3 Preferring a transfer petition at SC Supreme Court and hence case be adjourned for 4 months atleast.

 

Tell your financial needs and problems. Also file maint for kids at the earliest (once granted it is granted from date of application of maint and not the main case!!)

 

You need to file transfer petition at SC to transfer second case from coimbtore to mumbai.  (Don't get bogged down, it is a routine at SC. Why SC ? transfer is from one state to another. It would be adjudicated within one or two hearings. )

 

Ask for costs for each such hearing from husband.

 

(It will not take much efforts. collect good citation on it LAw is amply clear and favours women. There won't be any issues on this.)

 

Ask for travel and acco costs for each hearing in coimbtore.

 

Make a detailed list of costs and preserve all tickets and generally pay those by credit card of your or your relative or by cheque etc instead of cash.

 

You need to attend it atleast once (but don't let him know that you are attending) and ensure you narrate everything about 'transfer of case 'on the same day there.
