Need advice on section crpc125

Dear sir,

Good day to you,

I am physicaly challenged person (disablity 70%), My mother file the case on me CrPC125, She is asking maintainance from me through the court but I am unable to maintain my self, How can i pay her the maintainance? She is having sufficiant means(Own House), I dont have any regular income or any properties with me. at this stage, Should i have to maintain my mother? Experts please advice me on this matter,

dear rafi, under sec 125 cr.p.c there is a provision of maintenance of wives, children(legitimate or illegitimate), or parents is given. but it is written in the very first line of sec. 125 cr.p.c  that " if any person having sufficient means......at the first stage you are not fulfilling the first condition means you dont have sufficient means....so in this condition your mother cant claim maintenance from you.

she may claim but you have to contest it and satify the court about your inability in the absence of 'sufficient means'

Thanks for your reply, My layer also he is very confuse. He is searching for some completed cases, Which is possitive judgement given by judges for same case,Can you please post some recent cases & judgement given by indian court Judges for same case?

Don't mind my dear Friend

If she is your real mother than why she doing suct step. Perhopes  You are hide facts. Your mother know well that you are dissable . How can she become so rude.

Solve your problem in your House or in mediation. It will be better for you.
