Need legal advice on property purchase

We are an e-retailing company that is based in US but now we are expanding our business in Asian countries. However, we are going to open our traditional store in Mumbai and need your suggestions on following legal issues:

 

  • We are looking to purchase property in Mumbai for our store so what kind of legal terms and conditions are being imposed on foreign companies in this regard.
  • Rather than NOC which other documents must be required to purchase a store in India.
  • Is property law and taxation system of India varies from state to state.
  •

You can purchase the property in India,after permission of Reserve Bank Of India.There after take objections from Local authority.

Hi All,

My father purchased land in March 2015 from seller who received this property as relinquishment deed. This deal is registered at sub-register office & only Sale Agreement has done. A sale deed is pending & we have ask seller to proceed with deed. He refuse to do that & sent us notice through lawyer that his step mother & sister has share in this property. We are NOT aware if step mother & sister have executed relinquishment deed in favors of seller. We deal with him only as his name mention in 7/12 & 8A.

My questions are

1) Can they (step mother & sister) claim in this property?

2) How can we know if they have executed relinquishment deed in seller's favor or not?

3) Can we file a cheating case against seller & ask him to protect our buying interest?

4) Are we safe in this deal?

1) Yes thery have share in that property. with out their consent u can't proceed to get it.

2) Just give public notice in local news papaer in vernacular language where the property is located with the help of local lawyer to know if ther is any deed done with respect to that property. If with in period of 15 day no objection is received then the property is cleared.

3)Yes definately seller made fraud with u. He cheated you by selling the property having rights of another person. You can notice to him by lawyer and order to what u want . If he agrees to full fill ur need then only ur in sage.

4) If he refuse to full fill ur demand then file case against him demand specific perfomance and damages, principle amount u paid to him.
