I need your expert advice to save my elder brother and family from my sister in law. Date of Marriage-20 Feb 2011.My sister in law and her family members have harassed my elder brother for 2 and half years and still doing it. My sister in law left the house close to 6 months after the marriage. She hails from Asansol (West Bengali) and we are settled in Hyderabad. My father was in paramilitary force and now he stays along with my mother. Her Mom and Dad including her maternal uncle and aunt keep coming to my brother’s house in Hyderabad without informing him and threatened many times that, they can do lot of things to my elder brother and my family. Almost for 8 months my brother was not in touch with my mom and dad due to pressure from in-laws and black magic (which we can’t prove and will not be accepted by law) but we got little evidence for using these things. We had numerous discussion with their family but its like “Reading a book to a Buffalo”. He has a baby of 2yrs old and after contacting lot of lawyers including one of the IPS Lawyer in Hyderabad MR Reddy, but even he said we cannot do anything. We paid him 20000 Rs for counselling and he promised to keep my family safe for any police intervention. He advised us to join Save India Foundation Group which we did and attended few sessions. My sister in law left the house many times and she was in her parents’ house for more than 6 months without in touch with my elder brother. She is very cunning, adamant and used abusive language to my family and even slapped my elder brother once. After that, she went to Delhi and took the baby along with her to find a job. Later on, she insisted that my mother should come and help her to handle the baby. Before this, she didn’t allow my family to touch the baby and we are not allowed to come to my brother’s house. When my elder brother and mother arrived to Delhi, the same day she again started misbehaving with my elder brother and they had to stay overnight in the railway station. They left next day via train. My parents stay separately in the same city. After many discussions, there was no fruitful result and they are not ready for divorce. We have not filed for divorce or file any complaint yet due to baby. Since, as per the law the baby will be with the mother till 14yrs and as we know , she will be brainwashed by then. My elder brother left his home yesterday as he couldn't bear anymore. Kindly suggest us. What could be her next step and what can we do to get rid of 498a.?
Note- My brother had a physical relationship with his ex-girlfriend which he revealed his wife. She keeps taunting him and including her family again and again. He does all the household work including takes all the responsibilities as an ideal husband. She didn't have any objection but for every discussion where my brother accepted it was his past not present. She keeps taunting my family and bring an outsider for family matters for a discussion.
***Important Points for filing a divorce under cruelty ***
1. She separated from my family after 6 months of marriage and mentally, verbally tortured my family. Again, she came back and started staying with my elder brother sepertly.
2. Her parents visited my brother’s house and threatened my elder brother stating they will use their power.
3. My elder brother was not in touch with my family for 8 months and was not allowed to visit his house due to his brainless wife and in laws.
4. She went to Delhi and again misbehaved with her husband. Due to which my mother and brother had to leave next day.
5. She left that house quite a number times and took another house for rent in Hyderabad without informing my elder brother.
6. They gave 1 lakh to their daughter which we deposited in her account and we have a bank slip as well, but the gold which we gave she took all the gold and gave it to her mon and not ready to bring that back.
7. She called my brother’s manager and office employee and created started spreading nonsense things.
8. 3 years my elder brother just compromised because of his daughter and we see no hope after speaking to all prominent lawyers. that we want that his daughter at any cost. We can provide better education and better facilities.
I am sorry for this long post but we are completly frustrated and tired of contacting multiple people on this.
