Observation of evidence

Dear Members,

I have heard that if evidence favourable to the delinquent official has been ignored, then the conclusion reached must be held to be based on no evidence at all. Is this true? If it is true, i will be greatefull if any one can tell me the related judgements of high court/supreme court for my reference.

Sir,

In one of the office file, a forgery has been taken place. The contention of the police is that I have only received the file and show some acknowledgement of receiving that file. As the acknowledgement is not mine, based on the peon's statement (he stated that I only received the file and gave the acknowledgment), they have named my name in the chargesheet and say that I  received the file and helped and conspired the forgery. If the signature for receiving the file is not mine, how can I defend that the signature which is shown as my signature, is not mine? Even thow I have requested Police to send that acknowledgment for forensic lab, they didn't do.
