Power of Attorney

Can somebody explain the step by step process of granting 'Power of attorney' to a family member while all of them are residing within the country?

Power of Attorney can be given by one family member to another member, irrespective of the fact whether the member granting the power is residing within the country or outside the country. It is usual for the person issuing the power of the attoreney to recite briefly the reasons.  Hence the process is simple. Discuss the matters and specific transactions with the a lawyer/consultant for suitable drafting and get this executed.

Not necessary that POA can be given only to family members, but to any one reciting reasons.

Is Durable power of attorney valid in India. IS there a format for the same. I understand this can be given by the alzeimers patient at the initial stage.

Please don't fall into trap if someone has ever suggested you to have a prescribed format for power of attorney.

Write/type all the necessary information on a piece of paper and put yours' signature on that and get it registered at Registration section.

If you have been staying abroad, the same simple procedure but that has to be endorsed/attested by the Consulate at Indian Embassy in the respective country and send it to the beneficiary who would do the rest as suggested.
