This query is in connection with the Telangana State Public Distribution System (Control) Orders, 2016. The Clause 24 (1) of the Telangana State Public Distribution System (Control) Orders, 2016 states that "minor variation in respect of single commodity upto 1.5% may be allowed taking into consideration of transactions of one month" However, here few inspecting officials are booking the cases under Section 6-A of the Essential Commodities Act, 1955 against the Fair Price Shop Dealers, if the ground balances are found to be in excess than the book balance, though the variations are under permissible limits. No cases are being booked, if the ground balances are found to be in less than the book balance. In this regard, it is requested kindly to clarify that the variations are applicable only for (-) 1.5% or for both (-) and (+) 1.5%. It is learnt that earlier, the Hon'ble High Court of Andhra Pradesh has passed the judgment stating 1.5% variation should be considered in both the cases. If possible, please quote any such judgments.
