Refund of deposit paid during booking

I have booked a property in November 2011 of Mahindra Lifespace upcoming tower Royal Ivy in Great Eastern Garden,Kanjurmarg with a deposit amount of twenty three lakhs paid by me through cheque. I have been told that i can make the  formal Agreement with Mahindra Lifespace and pay the stamp duty and registration charges when they start the project as they are waiting for few approvals which is likely to be done very soon before starting the project in 2011.I booked the property on 24th of November 2011.They are suppose to start the project in end of December last year but still nothing coming up after six months.As this new tower Royal Ivy is the part of already existing society with five towers already in place i have been told by one of my friend in the existing society that there is no chance that this project is going to start as the existing society is not ready for it.Please tell me the legal options i have as they are not doing any communication.The whole payment was done through cheque. I have tried so many times to contact Mahindra Lifespace but never received a single call from them regarding the status of the project.Me and my family are now having big mental pressure because of that.How much time and money it would take if i go through the court and am i liable for any compensation for the loss. As the property prices increased in the vicinity i was interested and big loss of time too.
