Remove 11 kv for telecom tower from residential land

We belong to economically weaker section. Due to my husband occupation, We live outside of my native village. My village neighbour is a powerful person and in my absense On March 3 2021, he installed JIO telecom tower in his land and wired 11KV wire on my own residential plot without following any safety guidelines. Hence there is a great danger to my family life as well as domestic animals. This electric wire and pole constructed over my pond and many trees and crossed the village road. How dangerously they have constructed. Since last 3 month i am requesting to Junior Electrical Engineer, Regional SDO of Electricity Department, Executive Engineer of Electricity Department, Regional Tahasildar, Collector to remove the 11 kv electricity pole from the residential land so that i can construct my rest house. But they are not listening to me. What i can do ?

The fact to be stated is as to whether there was any type of encroachment on your land.  If there is no encroachment and if the tower had usual permissions/approvals for such civil construction from Panchayat. there is nothing that can be done.  At the most, you may insist for sensing or constructing the compound wall.around the tower

Yes the neighbor encroached my land. A case was already registered in local police station.Upon mutual consent  Neighbor  agreed to measure the land by govt amina last year 2021. But due to corona pandemic everything was running late. In the mean time that neighbor installed the tower in his land and  wired the 11 kv.in my land in my absense.

First, you should get a surveyor certificate demarking the boundaries and then issue legal notice both to the JIO tower maintenance engineer and to the landowner, and then if there is no response, you have to contact a local advocate and file suit for immediately removing the sensing and for compensating you for the illegal use.

Also, issue a notice to the Electricity dept., to remove the unauthorized poles and wiring and demand compensation for usage and harassment.  Make them also as a party in the notice and suit.

You may first issue a legal notice to the electricity department instructing them to remove the electric cable that have been installed on your land owing to it posing danger to human and cattle.

After that you an file a suit for mandatory injunction to remove the material from your land which has been installed illegally on your land

The posting appears to be made without ascertaining the facts. Such transmission lines are laid down following a due process governed by the provisions of Indian Telegraph Act. The competent authority to address your grievance, if any, is the District Collector.
