Hello:
A Cr. Case is filed by me under NIA 138. This case is posted for Judgement in Jan 2016 [ Yes 12 months ago]. No judgement yet.
As a Complainant / Plaintiff I win the Recovery Suit filed on the same Cheques.
Now, The defence has filed for reopening the Cr. Case to summon some documents from the bank under sec 91 cr.p.c.
1. Isn't there anything in law which states that the Trial must be progressive and we can't go on in indefinite loop?
2. Can the Cr. case be reopened when it was pending for judgement ?
Please help me with relevant laws / judgement citations.
