Return of stridhan and articles

Dear educated advisors,

I was married in 2007, and my wife deserted me in February 2008 citing harassment. I made many attempts to reconcile, however she was headstrong to come back. So I filed for divorce on cruelty grounds and she filed rcr, which was granted in 2009. Even then she delayed but 2012 we met accidentally in a temple festival and decided to put our past behind. So I withdrew my case un conditionally. We lived together for an year from sept '12 -'13, but she soon started to show her true colours, and filed DV and harassment in Aug 2013 and I got AB for the same. Now there is a pendency of divorce proceedings at family court chennai.

I would not like to live her any more , come what may. She had taken her gold jewellery at time of complaint in police station and I have a letter for the same. I wish to return all her items which are lying with me for more than 7 years like her bed,cupboard, kitchen articles, wardrobes etc. 

please suggest a way forward to send these back as I am told that these cannot be returned unless the respondent files seeking it, but I want to get rid of them.

Gentleman, go and give a complaint in writing with of yopur area or the SSp, with a request that your wife and in laws be asked to take away ISTRIDHAN, your liabilty will be immediately over, whether they accept to take back the stuff or refuse to take back, u will be on sound footing in the Court

You wait for the court proceedings t come to an end or she makes a claim in the court for return of her articles.  It would not be advisable to approach Police requesting them to direct yur wife to collect all her articles, police have got many other jobs to do than this. You dump all her articles in a separate room bundled up in gunny bags and keep the room locked till the time she comes with a claim for it or file a petition before the court seeking its intervention to dispose the same to her in the method and manner she prescribes.

Dear Sir,

I havent touched these articles for more than 6 years now as we awaited as per your reply. She has taken her jewelry back except her wardrobes. These are occupying uneccesary space in my house and I would not like to have these with me anymore as I have decided to separate come what may

I would like to proceed as per your alternate suggestion to file a affidavit in the court seeking it but my counsel says that it may not be accepted. Hence I would like to dispose of these at earliest to atleast send her a message that she is NOT WELCOME anymore.

mr kalaiselvan has rightly advised on your query. dumping away her belongings when the proceedings are going on will only show that you want to drive her away forcibily from your house. she is still your legally wedded wife. so you cant just dump the stuff away.
