Salary not given

Dear All, 

 

Satish Malgi here from Pune, was worked for M/s. Sampada Automotive Pvt. Ltd. , as Business Unit Head. As per the appointment letter, my CTC was 12.00 lacks / year.  

 

Company was not paying the salary on time. Due to some reason, Company was not paid my salary for the month of September 11 & October 11. Many time I had requested to Management regarding salary , but not happen. So that after Diwali i.e. 03rd November 2011 I had given resignation from my duties.

 

While joining, I was promised several false commitments from the management but working for around 3 months, all their promise proved wrong. The best evidence of this un-professional company is that not paying the salary to even the Business Unit Head ( Plant Head) .

 

I have been asking about my salary to the CEO then the CEO given response that due to you we had ( Company ) had facing financial problem and you are not able to make new business. In this company there is no marketing department & nor any profession manpower for doing the marketing job. This clearly shows the policy of the company & how they are just playing with the employees. I think for them the employees are just animals that they can hire anytime & getting their work done without paying them their salary.

I have around Rs. 30,000 as different EMI's and my whole family ( Wife , Son , Father & Mother) is fully depending on me.

Request your help to take up this matter very seriously & take up appropriate step so that the company will never ever think to play the way they are treating their employees. Request your immediate response.

It is believed that :

-you have been marking your attendance and no charge has been levied on you by company in writing.

-company has been pushing you to resign and square off amount payables to you with notice pay applicable in your case.

Have you submitted issues being faced by you ( as posted by you, promises, non availability of sales/marketing team etc) and non disbursement of your salary, reimbursements etc to your appointing authority, MD, Head-HR, Company Secretary, in writing under acknowledgment?

Has your resignation been acknowledged and accepted? Have you submitted company property, etc and cleared the exit formalities?

What is notice period applicable to you?

You may submit a list of documents and amounts payables by company to you, and amounts payable by company to you and demand settlement of your a/c and payment of your dues, by a written representation, under acknowledgment, addressed to good offices of your appointing authority, MD, Head-HR, Company Secretary, and request that same should be supplied to you say within next 7 days.

You should take a plea that since company was not paying salary despite many representations in person by you on dated……….( quote dates) to Mr/Ms…..quote names/dept/designation, and you were left with no other alternative, but to quit, hence notice period/notice pay has no sanctity and should be waived off.

 

You may contact o/o wages inspector at your location and lodge your grievance. You can also approach your lawyer/law firm, and issue legal notice.
