my wife has filed the Criminal MC case of sec 125 crpc against me & the same was dismissed by defult for she not appering for the case on long time. Now see has file the restore petion with a Sec 5 of limitation act i want know which is applicable or not applicable on the criminal 125 crpc.
please provide any judgement copy referance if any one having for my usage.

Application is for restoration... against the DID order... S. 5 applicable....

This is criminal case and hence no restoration application is allowed.
Yes but she can file fresh application u/s 125.
