Section 577, companies act 1956

Dear Sirs

In a pending suit, a party-defendant (originally partnership firm) is converted to a company under Part IX companies act, 1956 and thereafter Hon'ble court ordered that the matter shall proceed ex parte against the party-defendant.

 

Any case laws under Section 577 of Companies act 1956 to show that the legal proceedings shall proceed as it is without need to add the company as a separate party-defendant.
