Seller not vacating

I went into a Sale agreement for purchase of a house just adjascent to mine. The total agreement amount was 65 Lakh. I paid the margin money of 27 lakh through DDs (upon the seller's insistance, though I could have just carried out a Bank Transfer) due to which I had to spend an additional amount of Rs. 9300/-. The Balance money of 38 Lakh, I availed a Bank loan, and the Bank DD is ready with the bank for collection upon producing the Sale Deed.

 Registration has been carried out and the Sale Deed too is ready for collection. I received a message to this effect. Now, I just need to collect the Registered Sale Deed, mortgage with the bank and collect the DD, and hand-over to the seller. 

 The problem is, the seller has not vacated the house. Even the tenants are still residing in the ground floor, and the seller's parents in the first floor.I have intimated to the seller through email that I shall collect the Sale Deed and subsequently the bank DD and hand-over once:-

(a) The premises is vacated OR a rent is paid to me

(b) The DD charges incurred by me are reimbursed.

What is the way out if the seller is delaying both?
