Myself Faiz, I am the owner of my flat in our society in Mira road East - Thane District, four months ago I have been shifted to Hyderabad alone for my job purpose, but my family is staying in Mira road to continue my kids’ education and to take care of my retired teacher Sr, Citizen Mom. I often travel to meet my family on every 20 days gaps. I own one four wheeler car. As I am shifted to another city I haven’t taken my car with me. My car is parked in stilt parking slot for 20 days till I am not returned to meet my family. as my wife is a house wife not having driving skill knowledge, hence she is not taking car out confidently. However, in our society parking space is open for everyone and it is on first come first server basis, in our society no one owns any parking slot.so I parked my car in society parking slot for safety purpose. Now Society Chairman and secretory are having grudge on me and my family, so they had passed one parking resolution in coordination with 7 committee members without calling general Body meeting.
There is no parking issue in the society but MC are having issue on me “Why & How I am parking.
They passed the resolution that “parking is on first come first basis but would be valid till 2 days (48 Hours)”. With this resolution my family got impacted. They have made many society resolutions since they got elected in previous AGM and passing orders/resolution without calling GBM. With this behavior individual society members are getting impacted.
As they are torturing me and mentally harassing me and my family since many months, I lost the patience and abused them. With this fault, they reported issue to nearest police station and utilizing advantage of the situation to remove my car from parking slot.
As I am in remote city and physically not present with family, they took police man help and removed my car from parking slot forcefully by placing pressure on my family.
In our society there are 28 flat and we have 24-25 bikes parking space, and currently our society carrying 14 total bikes owners and three cars (one is mine - flat owner car and the other two are tenant's car). Sufficient space is there for parking, but still they are troubling as they are having grudge on me and on my family.
I have submitted complain letter against society chairman in the society office but they haven’t acknowledged it and they trashed it to dustbin. Because of my short stay at my home town, didn’t reported issue to nearest police station.
Now they parked my car in an open sky, and as owner of flat they are not letting me to do park my asset in to parking slot and stealing my general society rights.
By the way, I don’t have any pending dues to the society and never listed in defaulter member list as I am having practice to pay maintenance bill in advanced.
I am looking for your advice/help on this please.
- Is MC is allowed to take any resolution passed in coordination with 8 active committee members without calling GBM, this resoultion causing impact to society member (Targeted society member).
- In Society, MC Is allowed to pass parking resolution for 48 hours two days basis. As we are paying parking charges monthly basis.
- Is the MC justified in forcing me to park in a spot which will cause damage to my car?
- There is no parking issue in the society but MC is having issue on me “Why & How I am parking.
- Can Police Man intervention is appropriate to move my Car without Car Owner Knowledge without notice.
