I have few questions regarding Society and Association of Apartment owners.I am staying at a place where 9 different buildings such as A1, A2..A9 are there.Builder has developed this property and sold to the customers.He has done it in sequential manner. Means A1 was build and sold and then A2 and so on.
My flat is registered with Maharashtra Ownership Flat Act.
Builder did not form the society as the Registration Agreement had a mention of "Association"
being formed. This association was for each building.
Last year few of the wise people who are retired from government job started the "Gruh Nirman Sanstha"
in the same premise. They took the help from Assistant Registrar for this.
When I came to know about this, I started asking them how can they start the "Gruh NIrman Sanstha".
Then they started troubling me. In the February 2011, they disconnected my water supply showing false
due payments. I have registered an FIR against them then they started the connection after one week.
In the meantime, I decided to start the "Association" for our own building A5, they have srated threatening me.
Giving this background, I have below questions.
Can they register the society as "Housing Development Society"?
If the apartment is bind with MOFA 1963, why are they opposing the Association of Individual building?
Can I file case against the society and get the association as formal body?
