Thane housing society claims "miscellaneous expenses"

My society has levied Rs.2000 with the following explanation:

Non refundable Rs.2000/- (Rupees two thousand only) towards miscellaneous expenses to be recovered from the members while giving his flat/s on leave & license basis to new tenant. This is applicable with immediate effect.

This is in addition to the 10% non-occupancy charges that they are already charging. I paid this money (by cheque) because otherwise the society wouldn't let the tenant occupy the flat and I didn't want any issues with that.

My question is whether it is legal? If not, what legal options do I have to get the society pay me this money back?

Please advise.
