Transfer of property

Hello All

TYPE Location - MHADA 1 ROOM KITCHEN ( MUMBAI )

We are 5 siblings and from that 1 is on non talking terms since more than 8 years with all of us and is a NRI. Basically we are dead or alive he is not bothered.

Our last remaning parent our Father passed away on unforseen circumstances and there was no will.

My question is can the ownership name be transferred to any 1 of the 4 siblings and how ?

The 5th sibling is uncooperative and doesn't mind our fathers hard earned MHADA house going back to the goverment and he's holding our fathers ration card and will not return it.

The property is registered in whose name. It is felt that by death certificate, duplicate copy of ration card,legal heir certificate the property can devolve upon all legal heirs.

 

Inquire the process from the authority under whose jurisdiction the property falls: MHADA.

first of all you have no objection certificate from your non cooperative brother in order to transfer the ownership. if you are hindu then your fathers estate will go to all 5 kids in absense of will.

We are catholic.

 

So do you mean to say without NOC from the un-cooperative NRI brother we 4 sibings cannot do anything ?

Until or unless each legal heir attains rights equal to or that of owner no one can relinquish.

First of all the proeprty shall be mutated in the name of all eligible legal hiers.

Get the property mutated first.
