voice record of deceased person

hi all,

there were some quarrel happened between my mother and my wife. my wife recorded it without informing her. my mother died in 2019 and my wife lodged a divorce suit in 2021 on grounds of cruelty and want to submit the record in evidence.

Is it possible for her to produce before the court as Evidence as my mother expired in 2019 and there was no legal consent taken to produce in a civil suit.

please provide valuable suggestions and if possible case law for it

she will not get divorce just based on that. second deny that it is your mother's voice

Do not get your attention diverted to trivial issues and such threats.  Let her take action for cruelty by deceased MIL and let her expose her own attitude.  Focus on the real issue that matters.

It is for her prove the voice recording and if even it proved, it cannot be of much evidentiary value.

No, it can not be used in evidence.

However, it is better to consult your lawyer.
