An issue has arisen whether society commitee has the right to demolish a patio area as governed by by-laws. The owner has built a patio area as the builder did not do so. Further complication as the builder is still the legal owner of the complex but does not want to run the society. The complex is not complete as an old bungalow still exists which should have been removed ages ago but the owner will not move. What laws should the society management follow? The society was registered as a Maintenance society but some say it is now a Cooperative Society but no offical paperwork exists.
