will and codicil

If the will is registered and codicil is not registered is there any legal problem

Dear Querist,

 

As per the law it is not important to register both the will and codicil. If the will is a registered one and the codicil in question isn’t registered then also there will be no consequences to that. 

 

In the case of  Rajesh sharma vs state and others it was held that codicil if fully established on record and doesn’t gives any suspicious circumstances then it’s non registration doesn’t make anything invalid.

Unregistered will / codicil is valid and legal, if witnessed.

There is no problem that the codicil is not registered. But what is the constraint in registering the codicil as well?
