Withdrawl cash stolen inside bank in front of counter

The problem is continuing with RBI link...

As suggested by you the bank can be  held responsible for deficiency of service under Section 2 (1) (o) on the ground that ensuring safety of the money withdrawn inside the bank premises is implicitly part of service rendered by a bank to a customer. yes you can first report to the head office and wait for their reply and then file complain in the consumer court for this consumer court will take the complain 

and also if you have any witness at the time of the incident quote his name and his account number and the official who told you to wait for 2 min and the incident occured and the secuirty guard who had not helped at the tme

Sir, Thanks for advice and I follow the same. But I want to know, do I claim the amount to the Bank or Do I complain about the robbery happened in bank. As I already complaint about the robbery and negligence of not having CCTV to the bank on the very next day.

I want to clear it before going to consumer court.

Plz advice.

you have claim by bank because 

the place of robbery is bank which they had not provided the sufficeint security like cctv in the bank premises and the security guard who had not stopped the person who robbed you if he is employee of the bank means he has to take care till you come out of the bank and the responsiblility will be bank and sole bank only, the notice you write to the bank should be addressed to the offence committed bank give them a two days to reply and also sent a copy to head office if the bank does not respond then another letter to head office address the head of that place area manager with the previous letter and make them has the responsible do not go back and also quote that if you thus not respond and give my money you will go to court for justiice and if you have the website address about cctv take the print out and attach to the letter

The incident has haapened on 6.3.2013... The complaint has been given immediately... Let fresh complaint be given as suggested by you to the Branch, Regional Office and Head Office simultaneously... I feel the fresh complaint be drafted by a local Advocate ....Let the Police invsestigation continue.

in my view already 15 days is sufficeint now he can go personally to the bank and enquire if they does not respond then he should go to head office directly attaching all the correspondence till date to the bank as you said he may draft the letter by a advocate in which legal terms also will be added

If we do any email communication with the bank, is it the valid document to show in court or not?

Sir,


As per your guidance I submitted the complaint application to the branch and head off and personnaly I met with the grievance handling staff at there but they are arguing that the role of bank finished at the moment they handover the cash to me, and bank is not liable for the loss due to theft.

what I will do next? Do I file a complain at consumer court or wait?

As per police investigation, they have yet not started properly and I don't know how long it will take to get a investigation report. They are just saying different things different times.

 

Please reply and help me what to do?

When did you gave the compliant... When did you met their staff of Grievance handling? Please give them 15 days time to resolve... If there is no positive response from the bank in such time, ask your local advocate to file petition in the Consumer forum.

@Advocate Sastry,

I called the grievance handling manager 2 days back but he said it will take some time. It is been around 15 days giving complaint at head office. One staff said if Police report says that it was Bank's fault then they might consider it and might Bank can do something otherwise it was a bad day for you.

what should be in Police Investigation report ?

Earlier they said they have have the RBI circular and notice sent to bank for CCTV instalation but now they are saying I should collect it from RBI.

Where u stay? In Delhi or anywhere else?
