FACTS OF THE CASE
- The present petition is brought before the court vide an application made by the petitioner who is an accused under criminal law.
- In the application, petitioner-accused seeks legible copy of chargesheet and all necessary relied documents as per section 207 of Cr.P.C.
- As per the directions of the apex court in this matter, the legible copy of the chargesheet was provided to the petitioner dated 18.05.2023.
- However, the petitioner contends to get provided with relied documents in compliance to the aforementioned section.
- The present case is an old case with long years spent on the litigation therefore the court seeks to adjudicate it within a reasonable time period and not allow any further delay which may cause derailment of the proceedings.
CONTENTIONS OF THE PARTIES
- The learned counsel appearing on behalf of the petitioner submits that petitioner is entitled to be provided with the copies of documents aa laid down under section 207 of Cr.P.C.
- It was submitted by the counsel of the petitioner that the copies of documents which were provided to them in pursuance to the direction of the apex court were not legible.
- The additional advocate general appearing on behalf of the respondent submitted before the court that the direction of the apex court was duly followed and the legible copies were provided to the petitioner.
- The counsel raised a concern regarding the unnecessary stretch that would be caused by the petitioner due to unnecessary demand for adjournments.
OBSRVATIONS O THE COURT
- The court dismissed the above writ petition.
- The court directed the trial court to adjourn the case hearing for seven days and provide petitioner the legible copies of the documents.
- Court held that the petitioner-accused is entitled to the legible copies of documents in compliance to Section 207 of Cr.P.C.
- The court positively reacted to the concern raised by the learned counsel of the State regarding the duration of the litigation proceedings of the present case.
- It directed the trial court to proceed with the law in a time bound manner and in compliance with the law.
