The Delhi Court has convicted AAP MLA Manoj Kumar for obstructing election process during 2013 assembly polls. The obstruction affected the election process going at a polling station in Kalyan Puri area of East Delhi.
The Additional Chief Metropolitan Magistrate Samar Vishal observed that the then AAP candidate Manoj Kumar led 50 protestors at the main gate of an MCD school during 2013 Delhi assembly elections. Furthermore, the protestors closed the main gate of the school due to which the public servants inside the school were not able to do their duty and did not even allowed the ballot boxes to be taken back. The court also observed that the evidence led by the prosecution were reliable and trustworthy and justify the observation.
The court held Manoj Kumar guilty of obstructing a public servant in discharge of public functions, punishable under S. 186 of IPC and disorderly conduct in or near polling stations under S. 131 of Representation of the People Act.
