Advocate can be debarred for contemptuous behaviour in court: SC

The Supreme Court made it clear that if the behaviour of an advocate is contemptuous in a court, then he can be debarred from appearing in the court. A bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam, while refusing to stay the order of Jharkhand High Court debarring advocate K K Jha alias Kamal from appearing in any court in Jharkhand for a year, said, "Do you mean to say that a lawyer can do anything and the court will remain silent? Bar Council concerned can only suspend the licence or cancel the same but a court can debar an advocate from appearing in a court for any period of time if his attitude before the court is not proper and is contemptuous." The apex court adjourned the hearing of the case till December 2 and directed the state High Court to file its counter in the meantime.
