The clothes of 26/11 attack accused Abu Ismail, who died in police encounter during the attack on November 26 last year, were displayed in court today.
Seeing Ismail’s undergarment, which had holes at various places, designated Judge M L Tahilyani said, "Was the terrorist, who had an AK 47 in his hand, in such poverty." When Advocate Shahid Azmi, defence counsel of Faheem Ansari, asked whether the holes were present in the undergarment when he was conducting the panchnama, the witness assistant police inspector Subhash Narayan Warang was confused. Initially, he replied that there were holes in it and later he said there were no holes during the panchnama.
Abu Ismail’s trouser was also displayed in the court and there was confusion between the lawyer and witness over which was the right side and left side of the trouser. Later, Judge Tahilyani intervened and said it was the right side of front portion of the trouser.
Mr Azmi asked Mr Warang whether he did not know how to wear pants, over which prosecution lawyer Ujjwal Nikam took objection and said he was using unparliamentarily language and asking irrelevant questions in the court.
Judge Tahilyani said such language should not be used in the court and asked the defence and prosecution lawyers to maintain decorum.
