An intervention application has been filed in the Supreme Court by the Brahmaputra Valley Civil Society, an Assam based NGO, in the petition filed by the All Assam Minority Students Union challenging the constitutional validity of the Foreigner’s (Tribunals) Amendment Order, 2019 which was issued by the Central Government on may 30th, 2019, with regard to the power under Section 3 of the Foreigner’s Act.
The application by the NGO suggests some new ‘Standard Operating Procedures’ for the Foreigner’s Tribunal, which will hear the appeal of those excluded citizen from NRC.
The NGO states that the modified SOP will help adjudication fair, transparent and reasonable unlike the guidelines followed by the State NRC Coordinator. Inclusion of attempt to file new legacy person document will help the illiterate citizen to correct their mistake and provide the person a chance to be included in the list. This was not permitted on account of Rule 4(2) of the Annexure A1 and had given rise to exclusion of genuine citizen.
The Society has prayed the Hon’ble Supreme Court to accept the new SOP for Foreigner’s Tribunal.
