Bombay HC sets aside Maharashtra FDA orders on Subhiksha

Leading supermarket chain Subhiksha today said that the Bombay High Court has 'set aside' the Maharashtra FDA's orders regarding the company's warehouse in Mumbai and its vendors. The decision in this regard was taken by a bench of the Mumbai High Court on Friday, Subhiksha said in a statement. Maharashtra government's regulatory body for food and drugs, Maharastra FDA, had in mid-August passed orders of cancellation of license against three of Subhiksha's vendors and a 20 day suspension order on Subhiksha itself on charges of non-maintenance of health and hygiene norms at its Bhiwandi warehouse. The company had earlier secured a stay from the court on enforcement of the FDA (Food and Drug Administration) orders. "Subsequent to the hearings the Bench yesterday set aside the FDA orders against all four companies as bad in law. Further in respect of Subhiksha, the Bench ordered that the Commissioner FDA should re-decide the matter in accordance with law," the company said. "We had challenged the suspension order against our Bhiwandi warehouse and had full faith in the Bombay High court. The judgement has completely vindicated our stance," Subhiksha Managing Director R Subramanian told PTI. He added that there was nothing wrong in the company's warehouse operations or the hygiene of the products sold by it.
