The Supreme Court to hear today a PIL, filed by an NGO, seeking fresh investigation by apex court-appointed Special Investigation Team (SIT) into the Rs 1.76 lakh crore 2G Spectrum scam.

The petition has been listed as item number 51 before a bench comprising Justices G S Singhvi and A K Ganguly. 

The petitioner has also paid the apex court to monitor the investigation since the CBI was not conducting fair investigation in the case, in which former Telecom Minister A Raja is the main accused. 

A Comptroller and Auditor General of India (CAG) report has also mentioned that the Delhi High Court in its 2009 judgement had declared illegal the procedure adopted by the Centre in the allocation of 2G Spectrum as the number of applicants were restricted to 122 by pre-polling the cut-off date for applications by a week from October 1, 2007 to September 25, 2007 otherwise total applications would have been 465. 

The court had also taken note of the facts that information was illegally leaked to some of the firms in advance as these firms arranged demand drafts worth Rs 1,650 crore in just 45 minutes to obtain pan-India licences. 

The apex court will also consider the 47-page counter affidavit filed by Department of Telecommunications, defending the Minister and challenging the CAG authority in conducting the investigation in the scam. 

Union Law Minister M Veerappa Moily said the CAG report was not the conclusive proof of the guilt of Mr Raja and the government was prepared to face a debate on the issue in Parliament. 

Public Accounts Committee (PAC) of Parliament was yet to examine the report.
