Backlog and pendency of cases in courts is a major problem affecting dispensation of timely justice. The pendency in courts is not declining because filing of cases is either equal or more than the disposal. Giving this information in written reply to a question in the Lok Sabha, Dr. Ashwani Kumar, Minister of Law & Justice, said that since shortage of judges is one of the reasons affecting disposal, Government has decided in May, 2012 that number of judges in the subordinate judiciary needs to be doubled in five years. This decision has been endorsed by the judiciary and the Chief Justice of India has written to the Chief Justices of High Courts in February, 2013 to take it up with the State Governments so that the annual outlay by States on subordinate judiciary is increased.

Lately, the Conference of Chief Ministers and Chief Justices of High Courts held on 07th April, 2013, has also resolved that in order to improve the judge population ratio, State Governments in consultation with the Chief Justices of respective High Courts will take requisite steps for creation of new posts of judicial officers at all levels with support staff and requisite infrastructure. Dr. Ashwani Kumar informed the House that the Central Government on its part has committed to continue financial support to States for infrastructure and computerization of subordinate courts.

Well the Central Government has all the intentions; but when it comes to execution it is left to State Administration. As of today even the fast track courts which were in operation are abandoned, leaving the litigants high and dry. Let the leaders stop making tall promises; let them perform the small things.

Though Mr. Maniram Sharma pointed out comparative figures of judges and cases between India and USA, for which, I appreciate his analysis, but doubling the judges in the lower judiciary is highly needed because, even with such comparison, still we are backwards, and this crucial step is necessary to effectively deliver justice in a timely manner. Apart from this, due to complex legal system linked with technical and procedural issues, forged or fake document creation, and lie-witnesses, corrupt police and bureaucracy, illiterate or uneducated litigants, recruiting the lower judiciary staff is a highly essential and inspirational motivational step for transparency of the justice system. After all, my all fellow fraternity knows very well that "Justice delayed is justice denied". Hope others wholeheartedly appreciate this developing and forwarding step by the Chief Justice of India and all other Chief Justices of the respective High Courts, and the Government.

WHY A FIVE YEAR PLAN.? WHY NOT IMMEDIATE.? LOT OF ADVERSE DEVELOPMENTS DURING LAST ONE MONTH.? WHO WILL SEE/WAIT FOR 5 YEARS.? THE GOVT.DECISION'S SLOW PACE OF POLICIES RESULTS IN DELAYS AT ALL LEVEL. THEN NO USE BLAMING ANYONE.! POOR PUBLIC WILL CONTINUE SUFFERING.

The Govt is to do nothing but waste public money and nurse advocates, judges, munsis and police.rather it should infuse accountability among advocates, judges and police.

However 10% cases are dismissed on technical grounds or at preliminary stage in India. In 20% cases disputants tire out and compromise, in another 20% cases either witnesses or parties die and in 20% witnesses turn hostile due to long and frustrating trials. Only 30% cases reach final trial in India. Accordingly there is no shortage of judges in India.Already citizens are frustrated with the justice delivery system and only less than 10% of the litigants who have disputes are approaching the court," Justice Kirubakaran of Madras HC observed

Our leaders, advocates and judges are kidding innocent poor public. There are sufficient judges in India. A HC Judge of Madras disposes 5000 cases per year and there are 43,00,000 cases in HCs of the Country having 900 posts of judges. A Subordinate Judge of Kerala disposes 2500 cases per year and there are 2,70,00,000 in Subordinate courts of the Country having 18000 posts of judges. The SC, HCs and subordinate courts observe 100, 80 and 60 holidays in a year against 10 in USA. Advocates also observe 60 days strike on an average in India. There are 1.6 judges per lakh population in India against 10.81 judges in USA but the cases per lakh population in USA are 5806 against 1520 in India.

Mere increase of number of courts does not solve the problem. Trial Court Advocates will be burdened as they do not have permanent typist, stenographers, able junior coligues etc.,. Regular training to be given to document writers, public awareness of documentation on continuous basis needs to be provided. QUANTITY IS NOT IMPORTANT QUALITY IS IMPORTANT
