After the enactment of the Child Labour (Prohibition & Regulation) Amendment Act, 2016, Government has recently ratified the International Labour Organization (ILO) Conventions No. 138 concerning minimum age for employment and No. 182 concerning prohibition and elimination of worst forms of child labour.
The Child Labour (Prohibition & Regulation) Amendment Act, 2016 provides for stricter punishment and cognizable offence for employing any child or adolescent in contravention of the Act. The penalty provisions against violation of the Act are as under:
(i)In case of first offence of employing any child or adolescent in contravention of the Act, punishment would be imprisonment for a term not less than six months but which may extend to two years or with fine not less than Rs.20,000/, but which may extend to Rs.50,000/- or with both.
(ii) In case of a second or subsequent offence of employing any child or adolescent in contravention of the Act, the minimum imprisonment would be one year which may extend to three years.
This information was given by Shri Bandaru Dattatreya, the Minister of State (IC) for Labour & Employment, in a written reply to a question in Rajya Sabha today.
