Soon after Shri Prasad assumed the office of the Law Minister has asserted the factum of considering the matter for the creation of an All India Judicial Services and has quoted that, "We want good people into the judicial services and the selection should be merit based. There should be an intake of the best talent”.

The establishment of the same is based on the following contentions:[2]

  1. Article 312 of the Indian Constitution after amendment has provided for the creation of one or more All India Judicial Services by the Council of States approving the resolution of it by not less than 2/3rd majority.
  2. Law Commission’s 14th Report (1958) ad 116th Report (1986) have provided recommendation for the setting of an All India Judicial Services.
  3. The same stance has been supported by the Hon’ble Supreme Court of India in the case of All India Judges Association v. Union of India and the Delhi High Court in the PIL filed in 2016 has also directed the Government to take measures to seek feasibility for the creation of the same & thereafter to its establishment.

Therefore, the nation waits for the final decision on the same.
