A man filed a plea challenging the orders of the trial court and the appellate court of awarding  Rs 60,000 per month as interim maintenance to his wife to take care of their three minor daughters.

In his appeal against the lower court's decisions, he has contended that he is a pauper and his wife is running a business and therefore, he should not be over-burdened with the liability of maintaining either her or the minor daughters.

The Court of Justice Sanjeev Sachdeva has Rejected his contention and stated that merely because respondent-wife is earning, does not give an excuse to the husband to avoid the responsibility of maintaining his children. Delhi High Court further stated that one cannot assess the time and effort inputted by the mother in upbringing the child. If mother is earning, she should also contribute towards the expenses of the child but the expenses cannot be divided equally between the two.

Therefore, the high court has upheld the interim maintenance awarded to the woman.
