WHO IS TAHIR HUSSAIN?

  • Ex-member of AAP (Aam Aadmi Party)
  • Made headlines as the major contributor of initiating Communal riots
  • Ex-councilor of the East Nehru Vihar area of Delhi, India

WHO WAS THE TAHIR HUSSAIN'S AIDE?

  • Liyakat Ali, aged 63, a close companion to Tahir Hussain.
  • Has been accused of promulgating Delhi Riots which took place in the early part of 2020

GENERAL OUTLOOK

  • Liyakat Ali, along with his son Riasat Ali, had been accused of pelting stones, petrol bombs and leading a mob resulting to riots.
  • Prosecution had stated that they were working under the guidance of Tahir Hussain. But there is no legitimate proof to this statement that they were being guided in respect to the alleged offences.
  • Police has over three FIR's registered over him. The petitioner was alleged commission of offences under Sections 147/148/149153A/505/307/120B/34 IPC and Sections 27/30 of the Arms Act.
  • Liyakat Ali was under judicial custody since the date of his apprehension in April 2020

THE JUDGMENT

  • The verdict was given under a single-judge bench of Justice Suresh Kumar Kait
  • The petitioner had sought bail on the foundation that the crimes were falsely implicated in the FIR(s), they were distorted and that the accusations did not include any validity.
  • Later, it was observed that there was no electronic evidence like CCTV footage or legitimate videography or anything which could establish his presence at the scene of crime.
  • The petitioner was arrested on a vivid statement by one of the eye-witness but the person did not make any attempt to contact the authorities, there were some statements by the constables but they too did not contact any higher authority of any sort, even after being posted on the crime scene, therefore there wasn't any validity for the above statements.
  • The lack of legitimate evidence and improper facts paved a way for Ali to be granted bail. The court was of the opinion that since the investigation is complete, there was no cause of keeping Ali behind the bars.
