A Bench comprising Justices S B Sinha and A K Ganguly issued notices to Pappu Yadav and CBI on the petition filed by an aide of the slain MP who challenged the order of the High Court granting him bail.

The apex court sought their reply within six weeks.

Rabindra Nath Singh, an associate of Sarkar, contended that the High Court had erred in granting bail to the politician who was convicted and sentenced for life for the offence of murder.

However, senior advocate Rajeev Dhavan, appearing for Pappu Yadav, questioned the locus standi of Singh for seeking cancellation of the bail in the case which was prosecuted by CBI.

The High Court had on 18th February granted bail to Pappu Yadav who was convicted by Special CBI judge B M Srivastava on 14th February 2008.

Besides Pappu Yadav, former independent MLA Rajan Tiwari and another accused Anil Yadav were held guilty and awarded life term.

Sarkar, a CPI-M MLA, who had a running feud with Pappu Yadav over issues relating to farm labourers, along with his driver Harendra Sharma and party worker Ashfaqur Rehman, were gunned down at Subhas Nagar in Purnea town on 14thJune 1998
