The Supreme Court disapproved of students indulging in political activities in educational institutes by distributing pamphlets against the principals and teachers. A vacation bench of Justices Markandey Katju and Deepak Verma also refused to revoke the rustication orders passed by a college in Kerala against the petitioner, a girl student. Justice Katju, who was heading the bench, asked the petitioner ‘What type of student are you? You raised slogans against teachers and distributed pamphlets against the principal. Are you Mahatama Gandhi doing Satyagraha? This is gross indiscipline and educational institutions cannot function if students go around indulging in such activities.’ Justice Verma asked the petitioner through her counsel ‘Are you ready to take transfer certificate and join some other college?’ The petitioner Indu Lelha Joseph, a student of BA(Hons) English at Saint Joseph College affiliated to Mahatma Gandhi University, Kerala, was rusticated for indulging in political activities. The apex court directed the respondents to issue transfer certificate to her.
