In a major twist to Sister Abhaya murder case, the CBI today informed Kerala High Court that a Supreme Court Judge had visited the Forensic Science Laboratory in Bangalore and viewed the CD documenting the narco analysis tests conducted on the three accused in the case.



CBI counsel S Sreekumar stated before a Division Bench comprising Justices K Balakrishnan Nair and C T Ravikumar that the judge concerned, who was also former Chief Justice of Karnataka, appreciated the work done by former FSL forensic scientist Dr S Malini, who had conducted the narco analysis on the three accused-Father Thomas Kottoor, Father Jose Puthrikayil and Sister Sephy.



The investigating agency further stated that the Judge had visited the laboratory on May 23, 2008. The visit was recorded in the visitor’s register in there.



The CBI made the submission on the basis of a disposition by Dr Malini.



The investigating agency also found some photographs pertaining to the Judge’s visit to the lab. They were earlier handed over to the monitoring court- Chief Judicial Magistrate Court in Ernakulum.



The submission was made while considering a contempt petition filed by Sister Abhaya’s father M Thomas seeking to initiate contempt proceedings against CBI investigating officer Nandakumaran Nair and Dr Malini.



The petitioner submitted that Nandakumar and Dr Malini did not adhere to certain conditions in the bail order of the three accused, including retrieving the original tapes of the narco analysis.
