Texas-based company, Clear With Computers (CWC), is suing Apple and Hewlett-Packard (HP) in the Texas Eastern District Court for infringing upon two of their patents, namely the patent #5615342 entitled “Electronic Proposal Preparation System,” and the patent #5367627 entitled “Computer-Assisted Parts Sales Method.” In the Count I and II, the plaintiff alleges that Apple and HP are making and using supply chain methods, sales methods, sales systems, marketing methods, marketing systems, and inventory systems covered by one or more claims of the above named patents to the injury of CWC. According to the complaint, “as a result of these Defendants’ infringement of the ‘342 Patent, CWC has suffered monetary damages in an amount not yet determined, and will continue to suffer damages in the future unless Defendants’ infringing activities are enjoined by this Court.” The plaintiff is seeking a judgment and order requiring Defendants to pay CWC its damages, costs, expenses, and prejudgment and post-judgment interest for Defendants’ infrigement of CWC patents. The patent #5615342 was issued to CWC on March 25, 1997, and the patent #5367627 was issued to CWC on November 22, 1994. Neither Apple nor HP has commented on the new lawsuit.
